1. Introduction and Acceptance
Welcome to Fancrowd ("Platform," "we," "us," or "our"). By accessing or using the Fancrowd mobile application, website (fancrowd.app), or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
Fancrowd operates daily comedy video contests where users submit short-form video content and the community determines winners through voting. This is a game of skill, not chance—winners are determined solely by the merit of their content as judged by community votes.
2. Eligibility
To participate in Fancrowd contests, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater
- Be a legal resident of a jurisdiction where skill-based contests with entry fees are permitted
- Have a valid Fancrowd account with verified contact information
- Not be an employee, contractor, or immediate family member of Fancrowd or its affiliates
- Not be located in a jurisdiction where participation is prohibited by law
VOID WHERE PROHIBITED. It is your sole responsibility to determine whether participating in Fancrowd contests is legal in your jurisdiction.
3. Game of Skill Declaration
Fancrowd contests are games of skill, not games of chance. Winners are determined exclusively by:
- Community Voting: The video with the most votes at the end of each contest period wins
- Content Quality: Success depends on your ability to create entertaining, engaging comedy content
- Audience Appeal: Your skill in understanding and appealing to the community determines your performance
No element of chance, randomness, or lottery mechanism influences contest outcomes. The outcome is determined entirely by the skill of the participant in creating appealing content and the collective judgment of voters.
Free Alternative Entry: Fancrowd provides a free method of entry to all contests. Users may earn points at no cost through regular platform activity and redeem 2,000 points for a free contest entry ticket, with no purchase necessary. Free entries and paid entries receive identical treatment in contests — there is no advantage or disadvantage based on entry method.
4. Contest Rules and Entry
4.1 Contest Structure
- Contests run daily, with new contests beginning each day
- Each contest has defined submission, moderation, and voting periods
- Voting is open to all users; submitting videos requires an entry fee
- The video with the highest vote count at the end of voting wins the prize pool
4.2 Points-Based Entry System
Fancrowd uses a points-based entry system. One contest entry ticket costs 2,000 points. Points may be acquired through purchase or earned for free:
- Purchased Points: $2 buys 2,000 points (1 ticket), $5 buys 6,000 points (3 tickets), $7 buys 14,000 points (7 tickets). Purchased points contribute to the contest prize pool.
- Earned Points (Free Entry): Users earn points at no cost through various platform activities. Accumulate 2,000 points to redeem a free contest entry ticket — NO PURCHASE NECESSARY. Entries from earned points do not contribute to the prize pool. The specific activities that earn points and the amounts awarded may change at Fancrowd's discretion.
- Points purchases are non-refundable once redeemed for tickets and a video is submitted and approved
- Failed or rejected submissions may be eligible for refund at our discretion
- Free entries and paid entries receive identical treatment — entry method does not affect contest placement, voting, or prize eligibility
4.3 Submission Requirements
- Videos must be original content created by you
- Maximum video length: 60 seconds
- Content must comply with our Acceptable Use Policy
- One submission per user per contest
- Submissions cannot be edited or revised once submitted
- All submissions are subject to moderation review before appearing in voting
4.4 Voting
- Registered users receive unlimited votes
- Guest users receive limited daily votes
- Each user may vote on each video only once
- Vote manipulation, including use of bots, fake accounts, or coordinated voting schemes, is strictly prohibited and grounds for disqualification
- Votes are final and cannot be changed once cast
5. Prizes and Payouts
5.1 Prize Pool
- Each contest has a guaranteed minimum prize pool of $50
- Points purchased with money contribute to the prize pool; points earned for free (via voting) do not
- The winner receives 70% of the total prize pool
- Fancrowd retains 30% as a platform fee (waived if pool is below $50)
5.2 Winner Determination
- The video with the most votes at the end of voting is the winner
- In case of a tie, the video submitted first wins
- Winners are announced within 24 hours of contest end
- Fancrowd's determination of winners is final and binding
5.3 Payout Process
- Winners must have completed identity verification to receive payouts
- Payouts are processed via Stripe Connect or other supported payment methods
- Payouts are typically processed within 5-7 business days
- Prizes may not be transferred, assigned, or substituted
5.4 Taxes
Winners are solely responsible for all applicable federal, state, local, and other taxes on their winnings. Fancrowd will issue appropriate tax documentation (e.g., IRS Form 1099) as required by law for U.S. winners. By accepting a prize, you agree to provide any necessary tax information.
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of the content you submit to Fancrowd. However, by submitting content, you grant Fancrowd a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Services and Fancrowd's business, including for promotional purposes.
6.2 Publicity Rights
By participating in contests, you grant Fancrowd the right to use your name, username, likeness, voice, and biographical information for promotional purposes without additional compensation, except where prohibited by law.
6.3 Representations
You represent and warrant that: (a) you own or have the necessary rights to your submitted content; (b) your content does not infringe any third-party rights; (c) your content complies with all applicable laws and our Acceptable Use Policy.
7. Prohibited Conduct
You agree not to:
- Manipulate voting through bots, fake accounts, purchased votes, or coordinated schemes
- Submit content that violates our Acceptable Use Policy
- Use automated tools or AI to generate submission content
- Create multiple accounts to circumvent rules or gain unfair advantage
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorized access to any part of the Services
- Harass, threaten, or harm other users
- Misrepresent your identity or affiliation
Violation of these rules may result in immediate disqualification, forfeiture of prizes, account termination, and potential legal action.
8. Disclaimers and Limitations of Liability
8.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FANCROWD DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANCROWD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR PARTICIPATION IN CONTESTS.
FANCROWD'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FANCROWD IN ENTRY FEES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Dispute Resolution
9.1 Binding Arbitration
Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Texas, USA.
9.2 Class Action Waiver
YOU AND FANCROWD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.
9.3 Exceptions
Either party may bring claims in small claims court if eligible. Claims of intellectual property infringement or theft may be brought in state or federal court.
9.4 Opt-Out
You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. The notice must include your name, address, and a clear statement that you wish to opt out.
10. General Provisions
10.1 Modifications
Fancrowd reserves the right to modify these Terms at any time. Material changes will be communicated through the app or via email. Continued use of the Services after changes constitutes acceptance.
10.2 Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
10.3 Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.
10.4 Entire Agreement
These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Fancrowd regarding the Services.
